These Affiliate Program Terms and Conditions (“Affiliate Terms”) govern participation in the PepFlow affiliate program (the “Program”). The Program is administered by keinois OÜ (“we,” “us,” “PepFlow”). By applying to, being accepted into, or participating in the Program, you (“Affiliate,” “you”) agree to these Affiliate Terms, our Terms of Service, and our Privacy Policy.
If you participate in the Program on behalf of a company or other organization, you represent that you have authority to bind that organization to these Affiliate Terms. If you do not agree to these Affiliate Terms, you may not participate in the Program.
Program Overview
The Program allows approved creators and partners to promote PepFlow using a unique creator code, referral link, or other tracking method provided by PepFlow (each, a “Creator Code”). Eligible subscription purchases attributed to a Creator Code may qualify the Affiliate for commission, subject to these Affiliate Terms and any written Program instructions.
Participation is by application and approval only. PepFlow may accept or reject any application at its sole discretion and may set additional Program instructions in writing, including approved channels, promotional requirements, payment details, and brand guidelines.
Eligibility
- You must be at least 18 years old, or the age of majority where you live, and legally able to enter into these Affiliate Terms.
- You must provide accurate application, contact, tax, and payment information when requested.
- You must comply with all applicable laws, regulations, platform rules, and advertising standards in every country where you promote PepFlow.
- Employees, contractors, agencies, or representatives of PepFlow may participate only with written approval from PepFlow.
PepFlow may suspend or remove an Affiliate from the Program at any time if eligibility requirements are not met or if participation may harm PepFlow, users, or the Program.
Creator Codes and Attribution
A sale is eligible for Affiliate rewards only when it is properly attributed to your Creator Code by PepFlow tracking systems. Referred users must use your Creator Code or referral link before or at the time of the relevant subscription purchase or reward claim. If a referred user does not use the Creator Code in the required way, the sale may not be attributed and no commission will be owed.
- Creator Codes are personal to the approved Affiliate and may not be sold, transferred, sublicensed, or used by another person without written approval.
- PepFlow is not responsible for lost attribution caused by incorrect links, expired codes, user error, browser or device settings, platform limitations, technical interruptions, or failure to follow Program instructions.
- If more than one Creator Code, referral link, promotion, or tracking source may apply to a purchase, PepFlow will determine attribution in its sole discretion.
- Retroactive attribution is not guaranteed and may be denied for any reason.
Qualified Subscription Sales
A “Qualified Subscription Sale” is an eligible PepFlow subscription purchase by a referred user that is attributed to your Creator Code, accepted by PepFlow, not refunded, not canceled during any applicable review period, not fraudulent, and not otherwise excluded by these Affiliate Terms or written Program instructions.
Unless PepFlow states otherwise in writing, commissions apply to eligible subscription products only. Lifetime purchases, one-time purchases, free trials, free plans, taxes, refunds, chargebacks, credits, platform fees, payment processing fees, and other non-subscription amounts are excluded from commission calculations.
Affiliate Rewards
Approved Affiliates may earn a commission equal to 15% of eligible subscription sales attributed to their Creator Code, unless PepFlow states a different rate in writing. Commission is calculated on the eligible subscription amount actually received by PepFlow after applicable discounts, refunds, taxes, chargebacks, platform fees, and other excluded amounts.
PepFlow may hold, reverse, or deduct commissions for refunded purchases, canceled subscriptions, chargebacks, fraud, tracking errors, suspected abuse, breach of these Affiliate Terms, or any sale that PepFlow determines is not a Qualified Subscription Sale.
Approved Affiliates may also receive lifetime access to PepFlow so they can evaluate and demonstrate the product honestly. This access is personal, non-transferable, has no cash value, and may be limited, changed, or revoked if the Affiliate leaves the Program, breaches these Affiliate Terms, misuses the app, or if PepFlow changes or discontinues the product or Program.
Referred-User Benefits
PepFlow may offer referred users a discount, trial, promotional price, or other benefit for using a valid Creator Code. Any referred-user benefit is optional, may vary by subscription type, country, currency, tax treatment, platform, and availability, and applies only when the Creator Code is used as required before the purchase is completed.
Unless PepFlow states otherwise, referred-user benefits cannot be applied retroactively, exchanged for cash, transferred, combined with other promotions, or applied to lifetime or other non-subscription purchases.
Payments
To receive payment, you must provide any payment, identity, and tax information reasonably requested by PepFlow or its payment providers. You are responsible for all taxes, duties, and reporting obligations related to commissions you receive.
PepFlow will provide payout instructions, supported payment methods, minimum payout thresholds, currency, and payment timing in writing after approval or through the affiliate platform used for the Program. Commissions are payable only after PepFlow has had a reasonable period to review purchases for refunds, cancellations, chargebacks, fraud, and other exclusions.
If we cannot pay you because your information is incomplete, inaccurate, invalid, or not provided, we may withhold payment until the issue is resolved. We may close unpaid balances that remain unclaimed or unpaid for an extended period where permitted by law.
Affiliate Disclosures and Marketing Rules
You must clearly disclose your relationship with PepFlow whenever you promote PepFlow, share your Creator Code, or publish content that may generate commission. Disclosures must be clear, conspicuous, easy to understand, and placed where people will see them before they act on your recommendation. Examples include statements such as “I may earn a commission if you subscribe using my code” or prominent labels such as “ad,” “paid partnership,” or “affiliate code,” where appropriate for the platform and jurisdiction.
- You may promote PepFlow only through truthful, accurate, and non-misleading content based on your honest experience or genuine opinion.
- You may not make false claims, guarantee results, misrepresent features, imply that PepFlow is free when payment is required for paid features, or hide material limitations.
- You may not send spam, unsolicited commercial messages, or communications that violate email, SMS, privacy, or anti-spam laws.
- You may not use misleading ads, forced clicks, cookie stuffing, unauthorized coupons, fake reviews, fake accounts, bots, malware, adware, typosquatting, domain impersonation, or other deceptive or abusive tactics.
- You may not bid on PepFlow brand terms, misspellings, app names, domains, or confusingly similar terms in paid search or app store advertising without written approval.
- You may not suggest that you are an employee, agent, official representative, or exclusive partner of PepFlow unless we approve that wording in writing.
Health, Medical, and Safety Claims
PepFlow is a calculator and planning tool. It is not medical advice, diagnosis, treatment, prescribing guidance, or a substitute for a qualified medical professional. Affiliates must not present PepFlow as medical advice or imply that PepFlow can determine whether a peptide, medication, dose, injection protocol, or treatment plan is safe, appropriate, legal, or effective for a person.
- You may not provide individualized medical, dosing, diagnosis, treatment, or prescribing advice while promoting PepFlow.
- You may not claim that PepFlow prevents, treats, cures, diagnoses, or mitigates any disease, condition, injury, or symptom.
- You may not encourage unsafe use of peptides, medications, injections, syringes, or other regulated products.
- You must include appropriate cautionary context when discussing calculations, protocol tracking, health topics, or personal experiences.
PepFlow may require you to edit, remove, or stop distributing any content that we believe creates medical, regulatory, safety, brand, or user-trust risk.
Content, Brand, and Intellectual Property
PepFlow grants approved Affiliates a limited, revocable, non-exclusive, non-transferable license to use approved PepFlow names, logos, screenshots, product images, links, and promotional materials solely to promote PepFlow under these Affiliate Terms and written Program instructions.
You may not alter PepFlow brand assets, register domains or social handles containing PepFlow names or confusingly similar terms, create apps or products that imply affiliation, or use PepFlow intellectual property in a way that may damage the brand. PepFlow may ask you to edit, remove, or stop using any content, claim, link, asset, or promotion, and you must comply promptly.
Privacy and User Data
You must handle any personal information you collect or receive in connection with the Program lawfully, securely, and only for legitimate Program-related purposes. You may not collect, sell, or misuse PepFlow user data, and you may not represent that PepFlow has approved your own privacy practices. PepFlow processes personal information as described in its Privacy Policy.
Monitoring and Records
PepFlow may monitor affiliate activity, review promotional content, request proof of disclosures, audit referrals, and require changes to ensure Program quality and compliance. You agree to provide reasonable information related to your Program participation when requested.
Term, Suspension, and Termination
These Affiliate Terms apply from the date you apply to or participate in the Program and continue until terminated. Either you or PepFlow may end your participation at any time, with or without cause. PepFlow may suspend tracking, deactivate Creator Codes, withhold payments, remove content permissions, or terminate participation immediately if it believes you have breached these Affiliate Terms or created legal, financial, technical, reputational, medical, regulatory, or user-trust risk.
After termination, you must stop promoting PepFlow as an Affiliate, stop using Creator Codes, remove or update affiliate links and claims where reasonably practical, and stop using PepFlow brand assets except as otherwise allowed by law. Sections that by their nature should survive termination will survive, including payment adjustments, intellectual property, confidentiality, disclaimers, limitation of liability, indemnity, governing law, and dispute provisions.
Changes to the Program
PepFlow may modify, pause, or end the Program, Creator Codes, commission rates, referred-user benefits, eligibility rules, payment methods, or these Affiliate Terms at any time. Changes may apply prospectively unless stated otherwise or required by law. Continued participation after changes are posted or communicated means you accept the updated terms.
Independent Contractor Relationship
You and PepFlow are independent contractors. These Affiliate Terms do not create an employment, agency, franchise, joint venture, fiduciary, or partnership relationship. You have no authority to bind PepFlow, make commitments on behalf of PepFlow, or negotiate terms for PepFlow users.
Disclaimer of Warranties
THE PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PEPFLOW AND KEINOIS OÜ DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, TRACKING ACCURACY, AND EXPECTED EARNINGS.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PEPFLOW AND KEINOIS OÜ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, LOST GOODWILL, HEALTH ISSUES, PERSONAL INJURY, OR OTHER LOSS ARISING OUT OF OR RELATED TO THE PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, PEPFLOW’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE PROGRAM WILL NOT EXCEED THE COMMISSIONS PAID OR PAYABLE TO YOU FOR QUALIFIED SUBSCRIPTION SALES DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold harmless keinois OÜ, PepFlow, and their officers, directors, employees, contractors, affiliates, and agents from any claims, damages, losses, liabilities, penalties, costs, and expenses, including reasonable legal fees, arising out of or related to your Program participation, promotional content, breach of these Affiliate Terms, violation of law, violation of platform rules, health or medical claims, or infringement of third-party rights.
Governing Law
These Affiliate Terms are governed by and construed in accordance with the laws of Estonia, without regard to conflict of law principles, unless mandatory law requires otherwise.
General Conditions
- You may not assign or transfer your rights or obligations under these Affiliate Terms without written approval from PepFlow.
- If any part of these Affiliate Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
- PepFlow’s failure to enforce any provision is not a waiver of its right to enforce that provision later.
- These Affiliate Terms, together with written Program instructions, the Terms of Service, and Privacy Policy, form the entire agreement between you and PepFlow regarding the Program.
